Facts. Police find 10 plants, dried cannabis split into small bags, digital scales, £1,800 in cash and phone messages about "prices".
What the law says. Likely charges are cultivation and possession with intent to supply. Intent is inferred from quantity, packaging, scales, cash and messages (R v Morris).[15][37] "Expectation of significant financial or other advantage" points to the significant role: for cultivation, Category 4 significant starts at a high-level CO (range up to 26 weeks), and Category 3 significant at 1 year's custody.[1]
| If… | Then… |
|---|---|
| Credible explanation for cash, no messages | Possession / cultivation only |
| Messages showing sales to users | PWITS; "selling directly to users" → at least Cat 3 |
| Larger stock, repeated deals | Custody likely; POCA confiscation |
