What the law says. This is at the Category 3 indicative level (20 plants). Even with a lesser role, the starting point is a high-level CO (range low-level CO to 26 weeks' custody). If the court rejects the own-use account ("considering reasonableness of account in all the circumstances"), a significant role starts at 1 year's custody (range 26 weeks to 3 years).[1] A term of 12 months or less would now normally be suspended (Sentencing Act 2026).[4] Disputed facts may be decided at a separate hearing.
